GENERAL TERMS AND CONDITIONS

 

  1. Scope 

      • These General Terms and Conditions (“GTC”) apply to the use of the consumer web shop (“Web Shop”) of Studio 10119 GmbH (haftungsbeschränkt) (“Operator”), available at www.wellvern.shop. “Customers” can order products in the Web Shop.
      • Orders can only be accepted from persons of full age. Minors are only permitted to place orders with the express permission of their parents or legal guardians.

  2. Orders in the Web Shop 

      • The contractual partner for all contracts concluded via the Web Shop is the Operator.
      • The presentation of products in the Web Shop does not constitute a binding offer to conclude a purchase contract. Rather, it is merely an invitation to the Customer to submit a binding offer.
      • Adding products to the shopping cart by the Customer also does not yet constitute a binding offer to conclude a purchase contract.
      • Only by clicking the button “Order with obligation to pay” after completing the checkout process does the Customer submit a binding offer to conclude a purchase contract for the products in the shopping cart.
      • Before the order is submitted, the Customer is given the opportunity to identify and correct input errors.
      • As soon as a Customer’s order has been received by the Operator, the Customer receives an email confirming receipt (“Order Confirmation”).
      • The binding acceptance of the Customer’s offer by the Operator generally takes place by confirmation of the contract (“Contract Confirmation”) by email. The contract is then concluded at the moment the Contract Confirmation is received by the Customer.
      • The contract text is not stored by the Operator and cannot be accessed after the ordering process has been completed. However, these GTC can be accessed in their current version at https://www.wellvern.shop/.

  3. Prices 

      • The prices displayed in the Web Shop are prices in euros (or CHF for shipping to Switzerland) and include the applicable statutory value added tax.

  4.  Delivery terms and delivery restrictions
     
      • The Operator delivers to Customers throughout Europe (EU) and to Switzerland.
      • Delivery is made to the delivery address specified by the Customer within the delivery area.
      • Upon receipt of the Contract Confirmation, the Operator generally ships the products within a maximum of two (2) working days. From dispatch, the delivery time is generally a further two (2) working days (for Germany) and five to ten (5–10) working days within the EU.
      • Any applicable shipping costs are displayed in the Web Shop.

  5.  Accepted means of payment
     
      • Products in the Web Shop can be paid for using one of the following means of payment:
        • Credit card
        • PayPal
        • Apple Pay
        • Klarna
        • Google Pay
      • Regardless of the chosen payment method, the Customer receives an invoice by email upon request.

  6. Statutory consumer right of withdrawal

    The following withdrawal instructions apply to all contracts concluded under these GTC:

    Withdrawal instructions

    You have the right to withdraw from this contract within fourteen (14) calendar days without giving any reason. The withdrawal period is fourteen (14) calendar days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

    To exercise your right of withdrawal, you must inform us, Studio 10119 GmbH (haftungsbeschränkt), Torstraße 201, 10115 Berlin, fragnach@wellvern.shop, of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use our withdrawal form for this purpose, but this is not mandatory.

    To meet the withdrawal deadline, it is sufficient for you to send your notification of the exercise of the right of withdrawal before the withdrawal period has expired.

    Consequences of withdrawal

    If you withdraw from this contract, we must refund all payments we have received from you, excluding delivery costs, without undue delay and at the latest within fourteen (14) calendar days from the day on which we received the notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund. We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

    You must return or hand over the goods to us without undue delay and in any case no later than fourteen (14) calendar days from the day on which you informed us of the withdrawal. The deadline is met if you send the goods before the period of fourteen (14) calendar days has expired.

    You bear the costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods to an extent not necessary to check their condition, properties and functioning.

    ODR platform

    The European Commission provides a platform for online dispute resolution (ODR platform). The ODR platform is intended to help consumers and traders reach an out-of-court settlement in the event of problems. The ODR platform can be accessed via the following link:

    The Operator is not willing to participate in dispute resolution proceedings via the ODR platform or in any other consumer dispute resolution proceedings.

  7. Final provisions
  • Should individual provisions of these GTC be or become void or invalid in whole or in part, this shall not affect the validity of the remaining provisions.
  • Unless otherwise provided in these GTC, all declarations or agreements must be made in writing or by email. Contractual agreements are not covered by this restriction.
